The Government is expected to light the touch paper over raising the personal injury claims limit from £1000 to £2500. The topic of debate has been broached for a number of months now and is expected to receive fierce opposition from personal injury firms and solicitors who fear the move will decimate the personal injury claims market place.

The Government and insurance companies want the move in order to fast track more claims through the system but many believe the move will just deter many legitimate claims because they will simply not get the legal advice and cover they will need to support then through the whole personal injury claims process.

APIL representing the personal injury lawyers believes the move will ‘seriously limit access to justice’. Insurance companies favour the unprecedented move as it would obviously save millions in costs. There is clearly and financial and ethical stance to be viewed by these proposals.

At the same time insurance companies are welcoming moves to improve access to early resolution in case where liability is not and issue, they simply want to remove what they seems to interpret as the unnecessary need for expensive legal preparatory work.

Where defendants are open to liability there should be a simple and direct offering of personal injury compensation to the injured party. Lawyers are sure to oppose the situation by claiming inadequate payouts will be submitted – The scenario continues. Hopes are placed that a publication will emerge by the end of February.
