As of the 23 April 2007 it became an criminal offence for anyone to offer injury claims management services involving personal injury compensation claims without first being authorised through the DCA, Department of Constitutional Affairs.

An area of contention has always been the position of the insurance brokers who sell on their injury claims to firms of solicitors. It has been ruled that if legitimate LEI legal expenses insurance has been implemented then the insurance broker remains exempt, if however the LEI is not present then the transaction of selling the claims and offering claims service advice becomes illegal and prison sentences could easily be applied.
