Calls are being voiced to see personal injury compensation cases being launched much faster for victims of the Cumbria rail crash if it is found that Network rail is responsible.
The London to Glasgow Virgin rail train derailed in Cumbria on Friday 23 February killing an eighty four year old women and injuring dozens of other passengers. Initial findings are looking to show that points on the railway were not maintained properly and if this be the case there will be calls to see personal injury compensation cases being initiated much faster than in previous rail disasters.
The reason these calls are being made is because Network rail took over full control of railway maintenance following the Potters Bar Rail Disaster back in 2002, in this case the pointing of responsibility was passed from pillar to post leaving victims in need of claiming personal injury compensation in the dark for far too long. It was the intention of Network Rail to take away any uncertainty of whom is responsible for rail track maintenance and in this instance if it proves to be track repair that is at fault then injury compensation claims can be initialised toward Network rail and their respective insurers.
