Slips and Trips can occur at any time and any place
Despite a levy of bad publicity and a fair amount of abuse from certain individuals over the years, slip and trip compensation is still very much an important part of the personal injury sector. The fact is thousands of innocent people are injured every year in the UK as a result of falling or slipping on surfaces that have been deliberately or negligently left in an unacceptable or treacherous condition.
If you fall on a surface that has been left in such a state then you should make enquiries into whether you can claim slip and trip compensation from the party responsible for the surface. There does however have to be a balance of reason when considering slip and trip incidents for instance if there is adequate notice that the floor or surface is in a poor and dangerous condition then it is your responsibility to carefully avoid that area.
For instance if there has been a spillage of milk on a supermarket floor and a sign has been placed over it to indicate a slippery floor then the supermarkets duty of care has been met and it is your responsibility to avoid the area.
The same applies to timing aspects, if a pavement has been damaged and the council for instance is not aware then there is a strong possibility that a claim for slip and trip compensation might not be appropriate or possible because the Council simply have not been made aware of the same.
Abuse of the slip and trip compensation sector has been particularly rife in the area of pavements and roads where councils get inundated with compensation claims. Many councils have taken appropriate action in combating such actions and will not hesitate in taken action against anyone they believe is attempting to make a fraudulent personal injury claim.
This however should not detract any genuine claimants from coming forward to investigate whether they have a case for slip and trip compensation but remember there has to be a party at fault to make a claim, you simply cannot claim for compensation you are ultimately responsible.
